STM Australia is operated by Macnaught Pty Ltd (ABN 66 000 075 785). These Terms govern your use of the STM Australia website and purchases made through it.

Australian Sales Only

Products are offered for delivery within Australia only. The separate Shipping Policy applies to delivery arrangements.

Acceptance of Terms

By using this website or placing an order, you agree to these Terms to the extent permitted by law. If you do not agree, you should not use the website or place an order.

Website Use

Orders and Contract Formation

An order submitted through the website is an offer to purchase the relevant products. An automated order confirmation acknowledges receipt of the order but does not necessarily constitute acceptance.

STM Australia may accept or reject an order before dispatch, including where a product is unavailable, an obvious pricing or listing error has occurred, payment cannot be processed, or fraud or other unlawful activity is reasonably suspected.

If STM Australia cancels an order after payment has been received, any amount paid for the cancelled order will be refunded. This clause does not limit any rights available under the ACL.

Pricing and Payment

Prices are displayed in Australian dollars and include GST where GST is applicable. The total price payable will be displayed before the customer completes the purchase, subject to any optional charges selected by the customer.

STM Australia may correct pricing or product information errors. If an incorrect price has been displayed, STM Australia will not rely on this clause to remove or reduce any rights that apply under Australian law.

Payment must be received before dispatch unless STM Australia has expressly agreed otherwise.

Promotions, Discounts and Offers

Promotions are subject to the terms displayed with the relevant offer. Promotional terms must be read together with these Terms.

STM Australia will not make representations about discounts, previous prices, availability or promotional periods that are false or misleading.

Product Information

We seek to ensure product descriptions, images, specifications, dimensions, performance information and compatibility information are accurate.

Product images may be illustrative where identified as such. Minor changes in colour or appearance may occur due to display settings, photography or manufacturing variation.

Where a product has specific installation, operating, safety or compatibility requirements, customers should follow the supplied instructions and product information.

Nothing in this clause excludes consumer guarantees concerning description, quality, fitness for purpose or safety.

Availability

Products are subject to availability. Where STM Australia cannot supply an ordered product, we will contact the customer and provide an appropriate solution, including a refund where required.

Shipping

Shipping is governed by the separate STM Australia Shipping Policy.

Returns and Refunds

Returns are governed by the separate STM Australia Returns and Refunds Policy. That policy does not limit rights under the ACL.

Australian Consumer Law

The ACL provides consumer guarantees that cannot be excluded, restricted or modified by contract. Nothing in these Terms is intended to do so.

Where the law gives a customer a choice of remedy, STM Australia will respect that choice.

Manufacturer Warranties

Any manufacturer's or voluntary warranty offered with a product is additional to, and does not replace, the consumer guarantees under the ACL.

Warranty terms may impose reasonable conditions, but cannot remove statutory rights.

Intellectual Property

Unless otherwise stated, website content including text, product images, graphics, logos, trademarks, layout and other materials is owned by Macnaught Pty Ltd or its licensors and is protected by applicable intellectual property laws.

You may use the website for personal or lawful purchasing purposes but must not reproduce, modify, publish, distribute or commercially exploit website content without permission, except where permitted by law.

Third-Party Services and Links

The website may use third-party payment, delivery, analytics, marketing or other services and may contain links to third-party websites.

Nothing in these Terms excludes, restricts or modifies liability or remedies that cannot lawfully be excluded, including rights and remedies under the ACL.

Where liability can lawfully be limited, any limitation will apply only to the extent permitted by law.

Personal information is handled in accordance with the STM Australia Privacy Policy.

Suspension or Termination

STM Australia may suspend access to the website where reasonably necessary for security, maintenance, suspected fraud, unlawful activity or other legitimate operational reasons.

This does not affect rights arising from an existing purchase.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the courts and tribunals of New South Wales to the extent permitted by law.

Changes to Terms

STM Australia may update these Terms from time to time. Updated Terms will apply to future website use and orders after publication.

Changes will not retrospectively remove rights that have already accrued.
